To this end, it is based on the concept of legal interest as those circumstances or purposes that are useful for the individual and their free development within a structured social system. Based on this notion, the study seeks to determine what interest is safeguarded by this criminal offense and how its proper identification allows for the delimitation of the elements that define its typical structure. In this regard, Colombia’s business growth and the expansion of the stock market have highlighted the need to strengthen the legal framework that ensures the integrity of the financial system. Although this crime has been classified since 1990 and has evolved to protect economic interests beyond public administration, its jurisprudential and doctrinal development remains limited. Unlike other jurisdictions, such as Anglo-Saxon and European systems, where insider trading has been extensively studied and regulated, Colombia still faces gaps in its doctrinal analysis. This makes a systematic review essential to clearly understand both the legal interest it aims to protect and the elements that define its typical structure within the Colombian criminal legal framework.Ítem Marco normativo de la ciencia, tecnología e innovación como oportunidad para el Estado colombiano en la atención de la contingencia y las nuevas realidades a raíz de la COVID-19(Universidad EAFIT, 2020) Barguil Fernández, Maria Camila; Barguil Fernández, María Camila; Ortega Jaramillo, MauricioThis investigation seeks to identify the opportunities offered by the regulatory framework of science, technology and innovation, for the Colombian State, in the attention of the economic and social coyuncture caused by COVID-19, and its effects in the medium and long term, in a scenario of new realities. Therefore, to achieve the objective of this investigation, will be initially approach ¿What is COVID-19? and the impact it has generated around the world, and specifically, in Colombia. Subsequently, will be exposed, through a constitutional and legal analysis, some of the measures adopted by the National Government to deal the crisis, the formalities, limits, prohibitions and controls that faces, within the framework of the state of exception, and the actions of certain decentralized entities of the Executive Branch have taken in this juncture. Afterwards, will be proceed to identify the opportunities of the regulatory framework of science, technology and innovation, in Colombia, and how, thanks to these tools, currently, two success cases have positioned at the local level, Ruta N and the CUEE Antioquia, by the implementation of high impacts solutions for the current problem.
