Ítem Análisis de las medidas de política pública en pro del enfoque de género del Municipio de Itagüí a la luz de los lineamientos de la jurisprudencia constitucional(Universidad EAFIT, 2023) Cano Hoyos, Lina Marcela; García Jaramillo, LeonardoThe present research will start from a qualitative study with a hermeneutic analytical approach that seeks to understand and interpret the assumptions that make up the design of the municipal agreement regarding the gender approach formulated in the municipality of Itagui for the period 2015 – 2025. It examines whether said agreement, in its design and formulation, complies with the guidelines established by constitutional jurisprudence on the matter, emphasizing the importance of public policies as tools to promote well-being and social justice and, therefore, the need to address the gender violence and inequalities through effective public policies that achieve the materialization of constitutional guarantees. In this sense, the objective is to verify how the need to apply the gender perspective in public policies is derived from the principles and constitutional jurisprudence and to illustrate how these provisions are applied at the territorial level. Finally, it is concluded that constitutional jurisprudence does not establish specific parameters but does opt for the application of constitutional principles within the formulation of said policies, against which, the specific case shows a correct adaptation to said principles, however it is presented in a general way, which is why the importance of public policies on gender matters not being merely declarative, but rather translating into concrete actions that comprehensively address gender violence and gender inequalities, is highlighted. This involves the allocation of resources, the training of the personnel involved and the creation of effective monitoring and evaluation mechanisms.Ítem La caducidad en las pretensiones de reparación directa frente a los delitos de lesa humanidad, genocidio y crímenes de guerra en Colombia(Universidad EAFIT, 2020) Zapata Naranjo, Sara María; Diaz Diez, CristianThe Unification Sentence of January 29th, 2020, delivered by the Colombian Council of State, set a precedent on the mandatory nature of the common expiration term of two years, counted from the knowledge of the unlawful damage, to claim against the State for direct reparation derived from human rights violations, such as crimes against humanity, genocide and war crimes. However, the case law of Inter-American Court of Human Rights, indicated that, although imprescriptibility clearly operates in criminal actions, it is also possible that this guarantee of imprescriptibility applies to other actions such as those aimed at suing the State. The most important is to safeguard the integral reparation right, regardless of the action that is initiated, when we are faced with human rights violations. By means of Law 21 of 1991, Convention 169 of the International Labor Organization, hereinafter ILO, was incorporated into the Colombian legal system to its block of constitutionality in the strict sense. But it has been over the last decades that in judicial instances a precise development of the contents of the law has been made, being then the jurisprudence the formal source in which the details and requirements of the procedure can be consulted through concrete cases. In accordance with the above, so far it has not been possible to have a democratic debate in the legislative instance and there are opinions according to which it would be possible to achieve a regulation of the Prior Consultation that guarantees the right of participation of The Communities, the interests and rights of the actors of the measures, and the interests of the different state entities. These frustrated attempts to establish a systematic regulation in the legislative or administrative instance have given rise to some questions, gaps and problems regarding Prior Consultation at the legal, economic, social and political levels. In this sense, we insist on the important role played by the jurisprudence of the Constitutional Court in defining the parameters, contents and procedures regarding the right to Prior Consultation. However, given that the approach has been taken on a case-by-case basis, for a comprehensive regulation of the figure as it relates to the methodological route proposed by the Court in its jurisprudence, several opportunities for improvement can be identified according to the practical development of the Prior Consultation process. On the other hand, Prior Consultation is related to the central role that environmental protection has been occupying in the global and national public agenda, which may eventually enter into contradiction, affect the rights of the Ethnic Communities in the development of their culture or suppose limits for those who intend to develop projects or activities in the collective territories of such communities. Thus, the importance of the jurisprudence of the Constitutional Court to establish limits, parameters, obligations and precise contents is once again highlighted. In this context, the recent judgment T-248 of 2024 will be analyzed to establish the precisions and incidences of the Prior Consultation in the framework of the Court's decision. It is conceived as a union of multiple consensual and simultaneous romantic and/or sexual relationships whose members have loving, emotional and economic ties on a constant and lasting basis. In the face of our legal system and that of other external systems, it is a novelty that could pose some challenges with respect to the general rules, in this case, to family law. The purpose of this monograph is to identify and clarify the concept of polyamory as a new form of relationship and family. In this sense, it is proposed to use the concept of polyfidelity in the field of law. Then, it will be investigated in our jurisprudence the different pronouncements that the Court has had regarding this neologism, and it will be determined if the polyfidelity relationships are covered under the normative recognition; likewise, the advances of other legal systems in family law regarding polyfidelity will be examined.
