It has been determined that current regulations present legal implications that affect the job security and stability of Colombian workers, revealing that existing legislation does not always provide the necessary or adequate protection. Current laws and regulations do not fully contemplate situations of change in labor capacity, which may result in insufficient coverage and support for those who experience partial incapacity. We identified the causes of the phenomenon known as labor limbo, which occurs when a worker is in a state of uncertainty due to his or her disability not being fully recognized, which prevents him or her from working or effectively rejoining the labor market. The consequences of this situation include financial instability, employment discrimination and a general deterioration in the quality of life of the affected workers. The evaluation of the effectiveness of existing public policies and protection mechanisms from a human rights and social justice perspective revealed significant shortcomings. Workers often face barriers in accessing benefits and protection measures, suggesting that current mechanisms need to be reviewed and strengthened to be truly effective and equitable.
