It analyzes the concept of gender apartheid as a system of structural discrimination and institutionalized violence against women and other gender identities, comparing it to the racial apartheid and gender persecution regimes, defined in the Rome Statute. Through an interdisciplinary approach that includes international jurisprudence, human rights conventions, critical gender perspectives, and case study analysis, it examines the legal elements necessary to classify it as a crime against humanity. Análisis comparativo entre los sistemas interamericano y africano de derechos humanos(Universidad EAFIT, 2024) Osorio Echeverri, María Paula; Lorenzoni Escobar, LinaThis research paper critically analyzes the universality of women's human rights in a context of cultural pluralism, using their development in the universal, inter-American, and African human rights systems as a comparative framework. First, the theory of human rights is reviewed, and the evolution of international law and its protection systems is examined. The paper evaluates the situation of women and their differentiated rights in regional jurisprudence, conducting a comparative analysis of their development across these systems. Subsequently, a conciliatory vision is proposed that addresses both universalist and relativist concerns, allowing for the coexistence of perspectives within the heterogeneity of society. This investigation project intends to analyze the scope of the current regulatory framework from the United Nations Guiding Principles and to consider if, with the objective of proposing imperative norms and responsibilities to companies for human rights violations, they are sufficient or if a new international legal instrument is required to achieve this purpose. The two approaches taken do not present a dichotomy but do present different paths. First, the Guiding Principles, as soft law norms, are examined on their ability achieve the characteristics of hard law, in order to provide methods to bind companies in violation of human rights. Second, is analyzed a new international legal instrument centered on binding companies to damages their economic activity generates, and establishing positive obligations to prevent human rights violations, such as a treaty.Publicación Desafios de implementación de la regulación trasnacional aplicable en Colombia en materia de cambio climático, derechos humanos y la actividad empreserial(Universidad EAFIT, 2025) Montenegro Montoya, Alejandro José; Vallejo Piedrahíta, CatalinaThis research aimed to identify and describe the transnational regulations on business and human rights related to climate change that are applicable in Colombia. The study began with the recognition that, although there is a growing body of international and regional regulations on these matters, their implementation faces multiple challenges, particularly in contexts like Colombia. Through a dogmatic and historical-legal analysis of international treaties, soft law standards, European and Latin American regulations, and national legal frameworks, the study examined the evolution of transnational law and its capacity to influence corporate conduct in relation to climate change. The research found that, while Colombia has adopted international commitments and domestic regulations, normative gaps, institutional weakness, and a lack of coordination between public and private actors persist. It concluded that these limitations hinder the effective implementation of transnational standards in the country, affecting its alignment with international demands, especially those from the European Union. Finally, the study proposed measures to strengthen Colombia’s legal framework, including regulatory harmonization, institutional capacity building, and the promotion of corporate due diligence as a key tool to address climate change challenges from a human rights perspective.Publicación Doble instancia y doble conforme : antecedentes y estado actual en el derecho procesal penal colombiano y países latinoamericanos(Universidad EAFIT, 2020) Hernández Caro, Laura Melissa; Carvajal Quintero, Hilda Astrid.The present work is the result of a study on the background and the current situation in the countries of Latin America and especially Colombia, on the implementation and adaptation of the legal systems to the international human rights standards which it has been linked to; what have been the advances and shortcomings in the matter of substantial guarantees offered by the Colombian State against the subject holders of the rights stemming from the principles to the double instance, and the "double conform", as are the political granted and those convicted in double instance. It aims to give an account of the consecutive legislative and constitutional omissions in terms of the violations of human rights on the viability of choosing to apply the principle of "double conform" and double instance in procedural penal matter. And in the same way, to establish the current needs of a long and clear regulation on the subject, understanding what the legal basis of this action is, how proceeds, and whom proceeds.
