In particular, the problem related to the signing of a contract called BOOMT will be analyzed, which, in accordance with the public information disclosed by the Attorney General's Office, was maintained between two public entities, which, was also preceded by an inter-administrative agreement between two public entities that are partners in the mentioned project and also different legal entities from those that later signed the BOOMT. The narrated facts have led the Prosecutor's Office to consider that in this case, when the contract was signed as indicated, was committed the crime of signing a contract without compliance with essential legal requirements, contained in the article 410 of the Colombian crime code. In light of what was exposed above, we commit to carry out an analysis of the administrative laws that regulate public contracting and the domiciliary public service companies regime. From this regulatory rules compound, and based on the analysis of doctrine and jurisprudence, we will propose a deliberation to the problems of the criminal charges mentioned.Publicación Esquema asociativo territorial en la zona de Hidroituango y su viabilidad legal y política para la consolidación de la gestión supramunicipal(Universidad EAFIT, 2022) Úsuga Montoya, Esteban; Sánchez Lozano, Edith NataliaFrom the general information on the Ituango Hydroelectric Project, Empresas Públicas de Medellín affirms that it is the largest power generation project in Colombia with a contribution of approximately 2,400 MW to the energy system and that it represents one of the most important milestones in Colombian engineering. However, this infrastructure brings with it a territorial management component because it includes municipalities in the north and west of Antioquia, such as: Ituango, Briceño, Toledo, San Andrés de Cuerquia, San José de la Montaña, Valdivia, Yarumal, Peque, Sabanalarga, Buriticá, Liborina, Olaya and Santa Fe de Antioquia. In this context, the territorial entities not only share a reservoir or additional works around Hidroituango, but also have social, economic, cultural and political dynamics, which is why they could consider the possibility of associating to promote regional development. That is why the Land Management Law establishes that "the State shall promote associative processes between territorial entities for the free and voluntary formation of strategic alliances that promote the autonomous and self-sustainable development of the communities" (Law 1454, 2011, art. 9). The specific case of this paper focuses on the analysis of the legal and political feasibility of a Planning and Management Region - RPG, an Association of Municipalities or an Administrative and Planning Province as forms of associativity for the municipalities in the area of influence of Hidroituango. From this value, we generated a purchase recommendation, because the value of the stock at the moment of the valuation was COP $781, mainly as a result of market penalties generated due to the serious difficulties in which the Hidroituango hydroelectric project is in, the biggest hydroelectric project in our country so far. It should be noted that Conconcreto shared 35% of the main building contract of this project.
