Ítem Las incidencias de la práctica de la virtualidad en el proceso penal garantista(Universidad EAFIT, 2021) Mora Redondo, Wilmar Alejandro; Tamayo Patiño, Francisco JavierGuarantees in the criminal justice system, understood as the universal protection of the weakest and as limits to the power of the judge, have been threatened by the COVID-19 pandemic as a series of unfortunate decisions have been made due to forced social isolation. In the first place, a significant amount of improvisation led to the suspension of judicial terms causing an unfortunate precedent akin to the interruption of the rule of law, even when strict enforcement of current regulations would have sufficed. Secondly, virtuality was introduced with a great deal of improvisation, contradicting criminal law guarantees and leading to the violation of the constitution and principles, that took a lot of effort to achieve. Thirdly, there was no in-depth analysis of the nature of the infringements of the guarantees that would make it possible to explore and find adequate solutions to the problems that made them seem apparently incompatible with virtuality.
