Ítem Evaluación de competencias legales en gerentes de proyectos en el sector de la construcción en Antioquia, Colombia(Universidad EAFIT, 2024) Ángel Restrepo , Juan Camilo; Gómez Salazar, Elkin ArcesioIn a world where project management continually faces challenges and failures despite the global dissemination of best practices across various fields, a critical question arises: Why are there so few contributions from the legal dimension in the field of project management, and consequently, scarce contributions and analyses that could improve its management? (Abudi, 2011) And that’s not all. Despite the effectiveness of the OPM3® Self-Assessment Questionnaire (Project Management Institute -PMI-, 2013)in evaluating and enhancing the capabilities of project managers and leaders worldwide, it is surprising that this methodology does not contain a single question related to legal aspects for awareness, understanding, and adoption plan. Given this scenario, and considering that 41% of projects are of "high complexity" and that 27% of projects are likely to fail even when there is "high maturity in management" (Project Management Institute, 2021), it becomes imperative to address this issue comprehensively to reduce error rates from this scientific perspective (MacNeil, 2022). Therefore, the fundamental purpose of this work is to explore the critical importance of the legal discipline in project management and, simultaneously, how it can provide a range of knowledge and experiences that can enhance the competencies of project managers and, consequently, project direction. Just as other fields, with more developed analyses and contributions, have positively impacted project outcomes, the legal dimension can also be key to fostering successful project management through the knowledge it can address and disseminate. This can help develop better decision-making capabilities in leaders and, consequently, mitigate unnecessary risks or actions. To achieve this purpose, this investigative initiative based its analyses and recommendations on several globally recognized methodologies, such as the PMBOK Guide® 6th Edition and OPM3® Self-Assessment Questionnaire. These served as the foundation for designing and constructing the instrument used to formulate legal questions for each knowledge area and to evaluate the legal competencies of project managers in the construction sector in Antioquia, Colombia, according to maturity levels. Subsequently, interviews were conducted using the designed instrument, revealing that 40% of project managers did not consider how to address legal conflicts in the project charter, and 40% of projects did not meet legal deadlines. Additionally, only 20% of projects included legal costs in their budgets, and 50% lacked clear mechanisms for managing legal claims. These results were analyzed under the PMBOK Guide® 7th Edition performance domains, enabling precise recommendations to improve the legal capabilities of project managers. Given this panorama, this work aims to fill the legal gaps that have been insufficiently developed and disseminated in project management and contribute legal knowledge to project leaders. Such an intention will undoubtedly transform the way projects are approached and increase the chances of success and/or reduce errors. It is time to recognize that the legal dimension, like other disciplines, can keep any project afloat in turbulent waters.
