The subject has been stigmatized greatly and the morality of the act has also been questioned. Suicide or attempted suicide has even been criminalized by some laws around the world. The debate on the insurability of suicide in Colombia rests on the one hand on the motivation of the policyholder who acquires a life insurance policy and then dies by suicide (being also the insured), because it is questioned if they acquired the policy in good faith; and on the other hand, on the definition of the suicidal behavior because it is questioned if it fits the definition of insurable risk of article 1054 of the Commercial Code and the description of uninsurable acts of article 1055 that reads that acts that rest exclusively on the will power of the policyholder cannot be insured. In this writing we will explore the historical path of the insurability of suicide, the current legal doctrine and jurisprudence, as well as the influence that this has on the life insurance contract.
