Based on this premise, the arguments based on which both Constitutional courts and the Supreme Court have reached such a conclusion are identified and analyzed. On the other hand, said decriminalization of the consumption of narcotic substances has not had as a correlation the establishment of a legal provision that makes the assumption referring to the coexistence of the decriminalization of consumption compatible, on the one hand, with the prohibition of trade of this type of substances, on the other, and, therefore, the way in which jurisprudence has highlighted the existence of both situations, but, in any case, without proposing alternatives that allow them to be made compatible will also be presented. Finally, an overview of the international drug control situation is presented as a point of reference to analyze the possibility of adopting a flexible drug policy that responds effectively and makes the existing problem compatible.
