    The aim of this paper is to question the reasons that legitimize the existence of the criminal offenses of homicide by mercy and the inducement or assistance in suicide, considering that these are quite problematic when it comes to justifying them in light of constitutional principles and human rights. While the Constitutional Court, in various rulings, has made statements and included important modifications that exclude medical professionals from criminal responsibility when carrying out any of these offenses under specific circumstances, it remains contradictory that two norms remain in force that limit, without apparent justification, the fundamental rights to a dignified life and the free development of the personality of the individual holding the legal right.

    This thesis addresses the challenges prostitution and economic exchanges for sexual services pose to Colombian law. It explores how state regulation or its absence affects various societal aspects, including human dignity, public health, and human rights. The study highlights Colombia's lack of systematic regulation regarding prostitution, with significant gaps in data and policies that hinder effective state intervention. Various theoretical approaches to prostitution—abolitionist, regulatory, and prohibitionist—are examined, showing the limitations and implications each holds for those involved in the sex trade, particularly women. The thesis calls for a nuanced legal framework that balances protection with individual rights and emphasizes the need for accurate data to inform policies addressing the social complexities surrounding prostitution in Colombia.

    Estado de cosas inconstitucionales en el Sistema Penitenciario Nacional colombiano y la necesidad de intervención de organismos internacionales (1998-2022)

    The Constitutional Court has defined as an Unconstitutional State of Affairs in prison and penitentiary matters the flagrant massive, generalized, systematic, restrictive and suspensive violation of a broad constitutional imperative and axiological catalog (which permeates, saturates and invades all the regulation of institutions, subjecting them to under parameters and philosophical assumptions as high as the principle of human dignity) in penitentiary centers mainly due to the inhuman and degrading conditions due to the lack of infrastructure, public services, health and overcrowding that the defendants face with “anticipated punishment without trial” and those convicted. As well as a criminal policy, incoherent, unstable, unsustainable, thoughtless, volatile, subordinate, populist, empirically unfounded, reactive, selective, discriminatory and lacking of a clear human rights perspective in the phases of primary, secondary and tertiary criminalization of the Colombian State. In making this decision, the Court has taken consideration the capacity of the penitentiary and prison centers, which is quantitatively 80,922 inmates. However, it has an estimated population of 97,289, corresponding to 73,099 prisoners that have been found guilty and 24,190 accused or unionized. Therefore, in response to the relationships of special subjection established between the administration and people deprived of liberty, that constitute a special position of guarantor on the part of the Public Administration based on international standards of respect for the dignity of inmates, the enjoyment effective of their inalienable and untouchable fundamental rights and in the face of the legitimacy of a normalized and dehumanized intramural detention that implies that in the end it remains fair "that the punishment entails a dose of suffering" this work proposes as a general objective to analyze the State of Things

    La instrumentalización del individuo en la concepción de culpabilidad planteada por Günter Jakobs : un análisis de compatibilidad con el principio de dignidad humana

    The present study aims to analyze the conception of guilt proposed by Günther Jakobs against the fundamental principle of human dignity. To this end, a research is proposed based on a qualitative approach and an analytical method, which is based on the critical recognition of the conceptions of utilitarianism, identifying its implications and possible interactions with Jakobs' theory of guilt, evaluating its incompatibility with the guiding principle of human dignity; likewise, the existence of possible connections between Jakobs' conception of guilt and the practice of instrumentalizing the individual to achieve specific ends in the criminal legal system is determined; similarly, the principle of human dignity is examined from ethical and legal perspectives, identifying its essential components and its relevance in the context of the theory of guilt proposed by Jakobs; finally, considerations are raised for a possible replacement of the principle of guilt that promotes greater coherence between Jakobs' theory of guilt, human dignity and the fundamental ethical principles in the field of criminal law.

    The present monograph pretends to determine and analyze the content of the principle of liability as a guiding rule of the Colombian criminal law system, which for this reason is one of the rules that constitutes the essence and guidance of this system, prevails and governs the interpretation of the criminal law system, in accordance with the provision of the article 13 of the Colombian criminal code -- For the above mentioned, the first step is to analyze the purposes that legitimize the existence in general of the criminal law, from which is derived the human dignity, and subsequently analyze the content of this principle in the Colombian constitutional system, based on the decisions of the Constitutional Court and the studies of the national doctrine in regards of the dimensions of human dignity -- Once this analysis is covered, the third chapter of this monograph pretends to study the content of which has been denominated as the broad principle of liability in accordance with the dimensions of the human dignity -- After this, there is an analysis about the function of the principle of liability in the system of criminal responsibility -- Lastly, there is a brief approach to some possible interpretative consequences of the Colombian criminal law system derived from the principle of liability in strict sense, based on its role as a guidance rule and leaving open the possibility to make of this rule a true guidance norm of the criminal law system
