    Apartheid de género : viabilidad jurídica de su codificación como crimen de lesa humanidad en el marco del derecho internacional contemporáneo

    This legal analysis explores the feasibility of including gender as a constituent element of the crime against humanity of apartheid under international criminal law. It analyzes the concept of gender apartheid as a system of structural discrimination and institutionalized violence against women and other gender identities, comparing it to the racial apartheid and gender persecution regimes, defined in the Rome Statute. Through an interdisciplinary approach that includes international jurisprudence, human rights conventions, critical gender perspectives, and case study analysis, it examines the legal elements necessary to classify it as a crime against humanity. It also addresses the potential impact of such classification on the promotion of gender equality, the eradication of oppressive practices, and access to justice mechanisms and reparations for victims and survivors of gender-based oppression globally.

    Desafios de implementación de la regulación trasnacional aplicable en Colombia en materia de cambio climático, derechos humanos y la actividad empreserial

    This research aimed to identify and describe the transnational regulations on business and human rights related to climate change that are applicable in Colombia. The study began with the recognition that, although there is a growing body of international and regional regulations on these matters, their implementation faces multiple challenges, particularly in contexts like Colombia. Through a dogmatic and historical-legal analysis of international treaties, soft law standards, European and Latin American regulations, and national legal frameworks, the study examined the evolution of transnational law and its capacity to influence corporate conduct in relation to climate change. The research found that, while Colombia has adopted international commitments and domestic regulations, normative gaps, institutional weakness, and a lack of coordination between public and private actors persist. It concluded that these limitations hinder the effective implementation of transnational standards in the country, affecting its alignment with international demands, especially those from the European Union. Finally, the study proposed measures to strengthen Colombia’s legal framework, including regulatory harmonization, institutional capacity building, and the promotion of corporate due diligence as a key tool to address climate change challenges from a human rights perspective.

    In contemporary societies, crime remains a phenomenon that negatively impacts the development and security of a society. Therefore, states must implement criminal policies with the goal of preventing crimes, punishing offenders, and rehabilitating them. However, in Colombian society, it is crucial to question the approach being taken with these policies, as it is evident that the decisions made in this regard are not aligned with the ultimate purpose of punishment, a situation that goes against constitutional provisions. Through this work, we aim to analyze the focus that has been given to criminal policy and the consequences that have arisen, as reflected in crime rates and the current state of the penal system. This is done with the objective of determining whether the decisions made genuinely seek to fulfill constitutional objectives or, on the contrary, are merely discourses aimed at legitimizing the inhumane treatment to which the incarcerated population is subjected. To this end, the first part of this paper will examine the purpose of punishment and the true discourse that underpins the perpetuation of this system. In the second part, we will address the definition and characteristics of criminal policy, contrasting them with what the jurisprudence of the Constitutional Court establishes. Finally, we will analyze the need for reforming criminal policy.

    Ruta de gestión para la inclusión laboral de migrantes venezolanos en empresas de Medellín : un aporte desde la innovación social

    Migration implies significant social and cultural transformations for both migrants and receiving cities. Initially, Medellín faced significant challenges due to a lack of experience and social structure to address the needs of the Venezuelan population. This context has motivated various economic actors to undertake concrete actions that define labor inclusion and economic integration as priorities to overcome the challenges of this phenomenon. A common approach to addressing this problem is for migrants to rely on family or friendship connections, employment agency processes, or government programs to access decent employment. Despite these efforts, high unemployment rates, informality, discrimination, and wage and gender gaps have persisted, deepening the social vulnerabilities faced by migrants. This work conducted qualitative research through surveys and semi-structured interviews to assess the advantages and obstacles in the labor integration of Venezuelan migrants. As a result of this analysis, a pathway to labor inclusion was outlined, emphasizing the need to effectively manage each stakeholder’s capacities and promote inclusion as a process of social innovation through practical tools and strategic collaborations. This study seeks evidence to manage the increasing human mobility experienced by Medellín with the third wave of migrants. It aims to gather possibilities for implementing practical, systematic, and inclusive political and business actions. Finally, it promotes a narrative of social innovation and building trust relationships focused on closing employment gaps, reducing informality, and strengthening social capital through selected business cases that achieve more inclusion, diverse culture, competitiveness, and cohesion.
