    The following thesis will unfold the debate held against the preventive assurance measure, by assessing both arguments against and in favour of the measure. This analysis will locate itself inside Colombia jurisdiction and order of laws, specifically bill 890 of 2004, bill 1142 of 2007 and bill 1453 of 2011 which modifies the general criminal law bill, 906 of 2004. The analysis will explain, how a measure which in principle, is applied as a procedural measure, which strives for the integrity of the process, ends up in the forbidden territory of substantial and fundamental rights law, violating elemental principles such as liberty and the presumption of innocence.
