The objective of this comparison is to identify the role that these legal advisers and NGOs have played in the processes to access and formalize land tenure. The article assumes that evidencing the practices and legal services provided by organized civil-society stakeholders, as well as lawyers who respond to interests, reveal the influence of these actors in the changes of power dynamics on land tenure. Depending on the legal frameworks and approaches given to the enforceability processes on the right to land, either by property law or Human Rights, the outcomes are contradictory. On the one hand, the processes of access to the individual land conducted under property law generates fewer distributive results; on the other hand, accessing to land tenure through public policy or Human Rights standards lead to the contrary outcome, meaning more distributive effects. In this sense, the hypothesis suggested is that the practices promoted by property law lawyers tend to reinforce the unequal structures of land tenure; whereas, the procedures anchored to Human Rights Law tend to counteract the inequity in such tenure. The proposed analysis enables the understanding of the practice of diverse legal perspectives and tools in the protection of the access to land and its effects in Colombia. For organized civil society actors, the use of the discourse of International Human Rights law is prevalent, while for lawyers with particular and individual interests, resorting to property law is the dominant practice.Ítem Proyectos musicales independientes bajo la normatividad del derecho de autor en Colombia(Universidad EAFIT, 2023) Orozco Durango, Nicolás David; Roldán Gaviria, Ricardo León de la CruzMusic has gained unprecedented relevance in the markets thanks to its accessibility and diffusion by technological development. In Medellín, we see a growing number of emerging artists in the independent music sphere. However, this new sector of the music industry is still unknown to many entrepreneurs and legal professionals, which creates imbalances in the market and can harm creators. This thesis demonstrates that the new music industry allows independent music projects to be successful and generate income from the exploitation of their intangible assets, delving into the contractual relationships of the independent music market, its economic exploitation mechanisms, and its regime with the aim of providing an adequate legal overview to lawyers and other industry participants about the main negotiations surrounding musical works.Ítem El restablecimiento del equilibrio económico en los contratos de entidades públicas con régimen exceptuado de contratación en Colombia(Universidad EAFIT, 2023) Restrepo Ramírez, Juan Diego; Díaz Díez, Cristian AndrésThe binary conception of contractual regimes in Colombia —understood as the application of the private regime by some state entities and the General Statute of Public Administration Contracting (Law 80 of 1993) by others has generated practical difficulties in its implementation, due to the state nature of the entities that apply the private regime, since it does not regulate all the obligations or duties that state entities must meet or its application could be incompatible with the public purposes pursued with state contracting. One of these institutions corresponds to the economic balance of the contract, which is one of the problems widely discussed in court and, therefore, of great illustrative relevance to demonstrate the complexity of the duality of contractual regimes in Colombia. Given these difficulties, it is important to identify how the economic balance of services is restored in contracts concluded by entities with an excepted regime
