    Desregulación en plataformas de alojamiento a corto plazo vs. sector de hospedaje tradicional en Colombia

    In recent years, the collaborative economy has emerged as an international phenomenon that has transformed various traditional sectors, covering different areas, from transportation and deliveries to accommodation and rentals of all kinds. In this context, short- and medium-term rental platforms like Airbnb have become more popular and affordable than traditional hospitality, as they allow thousands of people to rent a cozy space for very short periods of time. It is no secret that this tourism boom has improved the economies of hosts who have offered their spaces to meet the demand for accommodation, which in turn increases the supply of the service. However, issues and concerns have arisen from the traditional sector, as there is no specific regulation addressing this new business model. Furthermore, the lack of regulation for these platforms in Colombia has raised normative and general interest concerns, given the potential for unfair competition, since they are not playing by the same rules as hotels or traditional accommodation service providers. This includes issues like fiscal obligations, taxable and tariff bases, and strict regulations, among others. This research aims to analyze the current situation of these platforms in Colombia from a multifaceted perspective, investigating the implications of their impact on the economy and legislation.

    Noción de la abogacía de la competencia: aproximación a los límites y las facultades de la superintendencia de industria y comercio frente a esta nueva figura

    One of the novelties in competition law was incorporated into Colombian legislation through law 1340 of 2009, known as Advocacy of Competition. However, its exercise and application is still very abstract, as well as the consecration of the aspects that regulate it, both in the normativity, as in the jurisprudence. With the present project, it’s pretended to study the figure of Advocacy of Competition in Colombia, that is, the nature of the institution, it’s origin and normative basis in current legislation, the criteria used by the Superintendencia de Industria y Comercio to emit previous concept to the government entities related to the intervention in the market. Likewise, it will analyze the scope of the faculties given by the legislator to the Superintendencia de Industria y Comercio in economic themes to intervene in regulations that may affect competition, and in the same way the limits that mark it’s possibility of intervention.
