    Victim’s right development under Colombian criminal processes to date, goes beyond the position granted by the legislator; it comes from constitutional case law with a starting point before the implementation of the current accusatory criminal system in a sentence related to military criminal jurisdiction, that gradually has reached the common justice criminal process, where the court, applying Article 93 of the Constitution, has used the constitutionality-block concept to invoke victim’s rights protection international instruments that, in harmony with other constitutional precepts has sought to guarantee the process form yielding a radical change both in fundamental rights that liberal criminal law had granted to the defendant, and in the current structure of the accusatory system with special features conceived under the Constitution and the Law
