However, the need and speed in the adoption and implementation of such measures triggered adverse effects seen from different spheres; specifically, the economic sphere, focused on foreign investment. As a result of similar crises, it is known that legislative and political changes increase the risk of foreign investments within a given territory and lead to an increase in the number of investment arbitration cases, where the need to think of defenses for host states arises. This paper argues that general international law (state of necessity) and emergency clauses can become instruments of defense for host States, applied to the context of possible investment arbitration claims, on the health emergency generated by Covid-19.Ítem El fenómeno de la expropiación indirecta en la inversión extranjera directa frente a los acuerdos de inversión(Universidad EAFIT, 2008) Baquero Montoya, Sara María; Mena Ramírez, Erika; Toro Valencia, José AlbertoÍtem Mecanismos de cohesión de laudos CIADI, casos en los que se reconoce los intereses al inversionista(Universidad EAFIT, 2017) Barajas Plata, Mario Andrés; Vanegas Restrepo, Susana; Toro Valencia, José AlbertoÍtem La relación de las compañías multinacionales con el sistema de derechos humanos(Universidad EAFIT, 2017) Mejía Arboleda, Susana; Toro Valencia, José AlbertoÍtem El Sistema Internacional de Inversión Extranjera Directa dentro del marco del desarrollo en Colombia(Universidad EAFIT, 2017) Botero Uribe, Alejandro; Toro Valencia, José Alberto
