Un problema de colaboración armónica entre poderes públicos(Universidad EAFIT, 2019) Lozano Salazar, Miguel; Montoya Brand, Mario AlbertoThe doctrine of separation of powers, as a political and legal construction, has been included by liberal states in their constitutions as a mechanism through which they can ensure the control of political power. Colombia has not been the exception to this rule. But the historical development of this doctrine showed its inability to address situations of tension between the different branches of public power or other organs that structure modern states. For this reason, the content of this article is to show the importance of the principle of the armonic collaboration for the Colombian State around transitional justice circumstances such as the one developed through law 1448 of 2011, kwon as the Victims Law. However, the transitional justice process prescribed in Law 1448 of 2011 is ineffective as a consequence of the lack of institutional coordination between the entities in charge of 5 implementing it. For this reason, the flaws in the implementation of the land restitution process will be shown, which impede the guarantee of the fundamental rights of the victims of dispossession and forced abandonment to the restitution of lands and the non-repetition of the events that led to their displacement from their territories
